The tenderer quoting the rebate more than 15%
( Fifteen percent) on the cost of work put to tender

or bank guarantee in favour of ‘FA&CAO, PARADIP PORT TRUST’ based on the amount calculated

INSTRUCTION TO TENDERERS

The authority reserves the right to reject any or all tenders without assigning any reasons
thereof and shall also not be bound to accept the lowest tender.

discretion, without assigning any reasons and the rates for the extra items/ substituted
items should be decided as per the relevant clause of the contract. The authority reserves

the right to split up the work to suitable portion and allot by portion to any party without
assigning any reason thereof. No claim whatsoever on any of the accounts shall be
entertained.

The earnest money of the successful tenderer will be forfeited in case he fails to turn up
or declines to sign the agreement or to deposit the Initial Security within 15 days being
called upon to do s
o after acceptance of his tender.


7.

SECURITY DEPOSIT & RETENTION MONEY

i)

where the contract amount is Rs.40.00 lakhs or more, a sum worked out on the basis
of 1% of the accepted tender shall be deposited by the Contractor towards security in
the form of cash/
irrecoverable Bank Guarantee with PPT within 15 days of placement
of work order. On deposit of SD, EMD shall be refunded. This supersedes the Clause
No.6.2.1B(I) of
CONDITIONS OF CONTRACT, PARADIP PORT TRUST. The
procedure for

Bank Guarantee should contain the name, reference of works, supplies or

the bank guarantee can not be given from a schedule bank functioning at
Paradip, Cuttack or Bhubaneswar then the bank guarantee should be

8.

The rates and units should be quoted both in words & figures otherwise the tender will be
liable for rejection. In case of di
screpancy between word and figure, amount stated in word
shall prevail and in case of discrepancy between unit rate and total, the unit rate shall
prevail. In complete tenders are to be rejected outright. The tenderers should also show
the total of each i
tem and the grand total of the tender. The tender shall be written legibly
and free from eraser, overwriting, corrections and mistakes in prescribed proforma, issued
by the Port Trust.

The successful tenderer, hereinafter called “THE CONTRACTOR” will be
responsible for payment of royalties, tollage,

patent charges for the items of work
or executing a part of work. All local taxes including Sales Tax, Income Tax, ferry
and tollage charges /
any other statutory taxes by Govt
. are to be paid by the
contractor for which extra can not be claimed.

The tend
erer must be accompanied with a certified true copy of the up

date
Income Tax and Sales Tax clearance certificate.

12.

The contractor should be fully liable to indemnify the Paradip Port Trust against
payment of any compensation under Workmen’s compensatio
n Act

VIII of 1923 on
account of workmen employed by him and the full amount of compensation paid
will be recovered from the contractor.

13.

If, however, in the interest of work, any material(s) other than mentioned in Causel
-
12 are to be issued by the Departm
ent on request of the
contractor the rates will be
fixed for such

issue as per prevailing rate of
the Department. The contractor shall give
his willingness for such recovery of rate before taking delivery of materials from the
Central Stores.


14.

Every tender
er is expected, before quoting rates to have inspected the site of
work, the drawings available in the Division office or CE’s office, quarries and
should satisfy himself about the condition of the site, quality, availability and lead of
materials. No re
presentation for claim of extra rate over the tender done on the
score of unsuitability of quarry and site conditions, etc. will be entertained in future.


15.

The tenderer must quote complete rate for different items. Tender containing indefinite
terms such a
s estimated rates percentage basis will not be considered where
percentage basis tenders are not invited.

19.

The receipt of an Accountant or Clerk for any mon
ey paid by the contractor will not be
entertained and the contractor shall be responsible for seeing that he procures a
receipt singed by the Financial Advisor & Chief Accounts Officer, Paradip Port Trust or
a duly authorized Officer.


20.

The work will have
to be carried out strictly in accordance with the design and
drawings (set of which can be had from the office of the Engineer
-
in
-
charge)as
approved from time to time.



The Engineer may make any variation, omission or addition in items of works

or part
thereof that in his opinion, be necessary and for that purpose and if for any other reason it
shall in his opinion, be as desirable he shall have powers to order Contractor to do any or all
of the same.


No such action shall, in any case invalida
te the contract, but the value(if any)of all
such variations shall be taken into account in determining the amount of the contract price
and time of completion.


21.


The Contractor will have to account for and make good at his own cost any damage,
defect
s, disturbance(s)and failure or any other eventualities ,etc. which might arise
during the period of execution for which no extra claim whatsoever will be entertained.

22.

Canvassing in connection with tender is strictly prohibited and the tenders s
ubmitted
by the tenderers that resort to canvassing shall be liable for rejection.

23.

The tenders containing uncalled for remarks of any additional condition(s)are liable to
be rejected.

24. The contractor shall maintain a claim book, serially numbered i
n order to record items
of work that are not covered up by this contract as climbable. Extra claims shall be
noted regularly in this book under the dated signature of the contractor or his duly
authorised agents at the end of each month. A certificate shou
ld also be furnished
alongwith the items to the effect that beyond the claims entered in the book, the
contractor has no other claim up to that date. If in any month there is/are no claim(s)
to record, a certificate to that effect should be furnished by th
e contractor in the claim
book. Each claim must be specified and that should give as far as possible the
quantities as well as the total amount claimed. The claim book must be submitted
regularly to the Executive Engineer concerned by the tenth day of each

month for his
views and orders. Claims not made in its manner are liable to be summarily rejected.
The Claim Book is the property of the Paradip Port Trust and shall be finally
surrendered by the Contractor to the Executive Engineer, concerned for record.


25.


Telegraphic quotations will not be accepted in any case.

26.


In case of any controversy, the decision of the Chief Engineer, Paradip Port
Trust will be final and binding.

27.

If at the time of excavation of foundation trenches, boring pile
, or any other excavation,
roots, vegetation or any other obstruction met with, the contractor will have to remove
these at his own cost.

28.

The Contractor, shall in accordance with the requirements of the Engineer
-
in
-
charge,
render all reasonable facilit
ies to other contractor(s) engaged simultaneously on
separate contract in connection with the work and for departmental labour and labour
of any other properly authorised or statutory body which may be employed at the site
on execution of any work not incl
uded in the contract or of any contract which Port
Trust may enter into in connection with or ancillary to the works.

29.

The contractor shall not be permitted to tender for works in Paradip Port Trust(responsible for award
and execution of con
tract)in which his near relative is posted as Divisional Accountant or an officer in any
capacity between the grades of the Chief Engineer and Assistant Engineer(both inclusive). He shall also
intimate the names of person who are working with him in any ca
pacity and subsequently employed by him and
who are near relative to any Gazetted officer in the Paradip Port Trust. Any breach of this conditions by the
Contractor would render him liable to be removed from the ‘APPROVED” list of contractors of the
Depart
ment.

Note:

The term “
Near relative
” meant as wife, husband, parents and grand parents, children, grand children,
brothers and sisters, uncles and cousins and their corresponding in laws”

30.

Illegal matters are to be referred to High Courts of Orissa,
Cuttack /Courts under jurisdiction of Orissa
High Court in Jagatsinghpur District.

31.

The offer should remain valid for minimum period of six months from the date of opening of tender.

32.

a) The work is subjected to inspection by Central Chief Techn
ical Examiner. Under sub

section 4 of

I of the Contract Labour (Regulation Abolition) Act

1975, the Contractor should have obtained license

“In case at any time it is found that the documents furnished by t

wrong/false/forge/fake, he will be black listed from Paradip Port Trust”.

The tenders which are not submitted in the official document (s) either purchased from the office
or down loaded from the website and are not complete in all respe
ct will not be entertained and will be
rejected outright.

36.

The contractor will not sign any Memorandum of Settlement in any form at any level without
knowledge of the Principal Employer in relation to the Port works undertaken by you in the Port
premis
es. Any deviation to the above will be viewed seriously.

37.

The sand after being loaded to lorry should be covered fully by the arrangement of transporter
and there should not be any gap in the body giving scope for spillage on the road.

38.

The bidders
shall give an undertaking that they have not made any payment or illegal
gratification to any person / authority connected with the bid process so as to influence the bid process
and have not committed any offence under the PC Act in connection with the bi
d.

39.

The bidders shall disclose any payments made or proposed to be made to any intermediaries
(agents etc.) in connection with the bid.

Sales Tax on works contract will be borne by the Contractor for which no extra payment

SPECIAL CONDITIONS (TECHNICAL

The technical specifications contained in this section shall be supplementary and complementary to the
technical specifications described separately elsewhere in the tender documents. In case of any discrepancy,
the specifications contained in this se
ction shall prevail. Further, reference to IRPWM implies the latest version
of the Indian Railway Permanent Way Manual.


Through packing :

1.

Through packing consisting of the following works shall be done systematically in the following
sequence.



Openi
ng of Road :
Ballast shall be opened out on either side of the rail seat for a depth of 50 mm
(2") below the bottom of sleeper with the help of shovel or wire claw. The width of opening should be
up to end of sleeper on outside and on inside it should be
up to end of sleeper on outside and on inside
it should be 450 mm (18") for B.G., 350 mm (14") for M.G. and 250 mm (10") for N.G. from the rail seat.



Examination of Rails, sleepers and fastenings :

The rails, sleepers and fastenings shall be
thoroughly e
xamined; Defective sleepers shall be removed and loose fastenings tightened.
The kinks if any, in the rails shall be removed by jim
-
crowing.


Squaring of sleepers :

For this activity, one of the rails shall be taken as sighting

rail and on
this rail corre
ct sleeper spacing
shall be marked. The


position of the sleeper with reference to the second rail shall be checked with the help
of a T
-
square. The sleepers, which are either out of square or not at correct spacing,
shall then be attended.



Aligning t
he track :

The alignment of the track shall be checked by " eye
judgement", sighting the rail from a distance of about 4 rail lengths or so. Small error
in the alignment shall be corrected by sufficient ballast at the end of sleepers. Slewing
shall be d
one by about 6 persons by planting the crow bars deep in the ballast at an
angle not exceeding 30
0

from the vertical.



Gauging :

The gauge shall be checked and a uniform gauge within permissible
tolerance shall be achieved. The following tolerances * fo
r gauge variations including
the side wear are prescribed at the time of laying from considerations of riding comfort
provided uniform gauge can be maintained over long lengths.

The adjustment of gauge for different types of sleepers shall be done as prescribed by
IRPWM :


Packing of sleepers :

The base rail shall be sighted by the mate and the dip or the
low joints shall be lift3d correctly to ensure a perfect l
ongitudinal level of the sighting
rail. The sleepers shall then be packed by ' Scissors Packing Method. Four men shall
tackle on one sleeper simultaneously, two at each rail. The ballast under the sleeper
bed shall be properly packed by the men standing

back to back and working their
beaters diagonally by lifting the same up to chest level. While carrying out packing,
surfacing of the track. In case of wooden and steel through sleepers, it shall be
ensured that the sleepers are not centre bound and as
such a trough is made in the
ballast section at the centre of sleepers.


After completing the packing, the alignment and top shall carefully be checked and
minor adjustment carried out.


Repacking of Joint Sleepers :

The joint sleepers shall then be packe
d once again
and the cross levels checked.



Boxing Ballast Section and Dressing

: The ballast section shall then be properly
boxed and dressed with the help of a special template. The cess shall be dressed up
and its level maintained in a way that prope
r drainage is ensured.


Through packing shall be done on a programme basis after the monsoon from
one end of the section to the other

Regular Track Maintenance Format.


2.

Shallow Screening of Track Ballast

: T
his item of work shall be carried out in the
following manner.


The ballast shall be opened out to full depth in shoulders, 75 mm below the bottom of
all kind of sleepers and 75 mm between sleepers after which the removed ballast shall
be cleaned and put b
ack.


Two continuous spaces between sleepers shall not be tackled at the same time and
the work shall be progressed in alternated panels of one rail length each.


Screening of ballast in hot weather months shall be prohibited.


Replacement of damaged or br
oken fittings

: Broken, fractured or defective rails,
fittings and fastenings shall be replaced, wherever required.


Through Packing

: All items included in through packing shall be done along with
screening.


Making up of cess

: Cess when high shall be

cut and when low shall be made up
along with overhauling. A template shall be used for this purpose.

Picking of Slacks

:

The contractor shall pick up the slacks at isolated locations as per the specific
instruction of the Engineer in
-
charge
. This item of work shall include all activities as
prescribed for through packing. A certain no. of days in a week (normally one or two
days) shall be kept to pick up the slacks as per the instructions of the Engineer in
-
charge.
During Rainy season, no

through packing shall be done except in
special case through packing may be done necessary for safe movement of
trains and only slacks earmarked by the Engineer shall be picked up.


4.

Annual Programme for Regular Track Maintenance

:

The Contractor shall en
sure that track maintenance is carried out as per the annual
programme for regular track maintenance given by IRPWM which is shown in a tabular from
below.

side and catch water drains and water

ways.
During abnormally heavy rains, patrolling

of the
line by gangs should be carried out in addition to
regular monsoon patrolling.




Note : Scattered or casual renewals, creep adjustment and earth work
repairs shall be done as necessary.

DEEP SCREENING OF BALLAST

SPECIAL CONDITIOINS OF CON

1.

SCOPE OF DEEP SCREENING WORKS:

1.1

Procedure for screening ballast for providing proper cushion without a block is given
as under:

a)

Organize the work of a ballast screening party i
n such a way that at the end of the
each working day, there is no length of unscreened track left between screened length
of track. At the same time, it should be ensured that when ballast is being excavated
from under one sleeper ( as per procedure detail
ed below), there are at least four
sleeper between it and the next sleeper being simultaneously and similarly worked up.

b)

Remove ballast from space 'A' and 'B' on the either side of 1
st

sleeper '1' down to final
formation level and provide wooden blocks to
support the rail for passing trains.


c)

Remove ballast from under 1
st

sleeper down to final formation level.


d)

Screen ballast, place it back under 1
st

sleeper and pack it.


e)

Remove wooden blocks from space 'A'.


f)

Remove ballast from space 'C' down to formation
level and after screening, place is
space 'A' upto the bottom of sleeper, the balance may be taken outside the track and
screened. Support the rail in space "C" wooden blocks.


g)

Remove ballast from under second sleeper "2" down to formation level.


h)

Provide

screened ballast under sleeper "2" and pack it.


i)

Remove ballast from "C" down the formation level and after screening, place in space
"B" upto Bottom of sleeper, the balance may be taken outside the track and screened.
The wooden blocks should be removed

from space "B" and placed to support the rail
in space "D".


j)

Remove ballast from under sleeper "3" and soon on till the whole rail length is
provided with screened ballast upto even bottom sleeper.


k)

Lift track to provide additional cushion when required.


l)

Pack the track in the final position and then provide boxing.


m)

Lifting should be limited to "2" at a time.


n)

It should be ensure that the packing, cross levels and grade off are satisfactory before
leaving the day's work.

1.2

Deep screening o
f ballast, initial aligning, leveling and packing of track will include the
following items of works.


a)

Removing entire stone ballast including muck lying in the track between and
under the sleepers and on the shoulders. The depth below sleepers upto
which

the ballast and the much should be dug up will be specified by the
Engineer
-
in
-
charge. This will normally be between 15 Cms. And 30 Cms.

b)

Screening the ballast with screens of approved design to separate the clean
from muck, putting back the clean ballas
t into the track and disposing of the
muck, as directed by the Engineer
-
in
-
charge. The muck may be used for Cess
and slope repairs as directed by the Engineer
-
in
-
charge but should not be
dumped on slope of cutting or inside drains and catch water drains.

No extra
payment is admissible for such repairs.


c)

Adequate no. of wooden blocks to support the tracks for a passing trains while
the work is in progress shall be provided.


d)

Aligning and leveling the track and through packing under with the screen
ballast
adequately shall be done so as to pass trains at 10 KMPH. These
works shall be completed on the first day for the length taken up for screening.


e)

The track shall then be slewed to proper alignment with reference to centre line
peg already fixed. On curve

the track should be slewed to proper curvature
which should be ensured by reference to prescribed versions.


f)

The track should then be lifted where required in stages each stage involving a
lift or not more than 50mm. When the track is being lifted no tra
ins should be
allowed to pass over the spot until the lift is ramped out on either side suitably.
Lifts of more than 50 mm should not be done unless and until the PPT's
Supervisor is present at the spot.


g)

After each stage of lifting of track, "Packing" of

the ballast should be done
under all the sleepers to uniform standards, and the track consolidated
adequately to pass trains at speed of 15 KMPH. The next stage of lifting track
should not be commenced until the next day. This process should be
continu
ed stage by stage till the track is brought prescribed longitudinal and
transverse profiles.


1.3

Rear packing and consolidating of track" will include the following items of works :


A)

Adjusting gauge to tolerance specified in Para 1.4.

B)

Squaring all sleepers an
d tightening all the fastenings after making good
deficiencies.

C)

Adjusting the alignment, longitudinal and cross levels of track to being those
track parameters within the specified tolerance. On curved track, the curve
should be slewed to proper alignment

as per directions of the Engineer
-
in
-

Charge.

D)

Repeatedly packing and consolidation of the track :


Through packing should be done for a minimum of four times at the following intervals.


i)

First through packing on the next day of " Deep Scree
ning" after the work of
initial aligning, leveling and grading of track is completed. Speed restriction of
15 KMPH. Will continue.

ii)

Second through packing on the next day after first through packing is
completed. Speed raised to 30 KMPH.

iii)

Third through pac
king on the 7
th

day after second through packing. Speed
raised to 50 KMPH.

iv)

Fourth through packing on the 10kth day after third through packing. Speed
raised to 75 KMPH or sectional speed whichever is less.


During each round of through packing the alignm
ent, longitudinal levels and
cross levels should be progressively refined and the percentage of loosely
packed sleepers also reduced. If more rounds of through packing are found
necessary to bring the track parameters to prescribed tolerance the same
shou
ld be done. The decision of the Engineer in Charge in this regards shall
be final and binding on the contractor. In between the rounds of through
packing slacks should be picked up as required to ensure safety of traffic
passing over the track. The rate

contractor quotes should include this.


1.4

Rear packing and consolidation will be deemed to be completed only when the track
parameters confirms to the following tolerance.


Gauge : (
-
) 2 mm to (+) 4 mm on straight.


(+) means slack (
-
) means ti
ght.


Variation of only 1mm is permitted between two adjoining sleepers. If due to age and
condition of the permanent way materials existing on the track, the gauge can not be
set to these tolerance limits, the matter will be considered by the Engineer
-
in
-
charge
and such directions as he gives should be followed. His decision in the matter shall
be final and binding on the contractor.



Unevenness :

(+) or (
-
) 3 mm on 3.6 metre chord.

At isolated locations variations upto (+) / (
-
) 6mm may be permitted.



Twist :

1.5 mm per metre length of track.


Alignment :

+ 5mm on 10mtr chord on curves Versailles of any two adjoining
stations should not vary more than 20%.


Packing

: Not more than 02 sleepers should be found loosely packed when tested in
lots of 2
0 at a time. No consecutive sleepers should remain loosely packed.

1.5

Spreading & Boxing of ballast will include the following items of works.


a)

1.6

Repairs to Cess should normally be carried out with the muck removed after screening. The
Cess should be levelled and dressed to approved profiles. While doing so, care should be
taken to do leveli
ng and dressing of top of formation such that it slopes away at 1 in 40 from
centre of formation upto the top edge of the bank/cutting. The Engineer
-
in
-
Charge may
however order the contractor to carry out earth work repairs to the Cess where it is low by

taking earth from borrow pits. Payment for such work would be made separately on the basis
of borrow pits measurements or by taking levels.


2.

R A T E S :


a)

The quoted rate for each item in the schedule should be all inclusive of lead, lift through rate
cov
ering all the items described under scope of work.

b)

The quoted rate for a rear packing and consolidation should be on average rate per metre
length of track. The no. of sleepers may vary from 16 to 22 per 13 metre lengths of track.


3.

SPEED RESTRUCTIOINS :

3.1

Speed restrictions as required for safety of traffic will be arranged fo by the Engineer
-
in
-
charge. No work on the track should be commenced until the contractor has imposed speed
restrictions and erected speed indicators as per direction/satisfaction of

Engineer in Charge.

3.2

After a speed restriction is imposed, the contractor shall progress with the work in systematic
manner after obtaining specific authorization from the Engineer in Charge of the work in
writing and keeping the following consideration in

view :


a)

Before starting execution of work, the track should be protected by the PPT
(Engineering subordinate in charge of the work ) and the contractor should ensure this
before starting.

b)

Long length of tracks under speed restrictions should be avoided.

c)

Between imposition of a restrictions and the restrictions of normal speed, normally a
period of three weeks will only be allowed. During this time contractor should
complete all the works including final through packing.


3.3

If the contractor fails to emplo
y adequate labour for attention to the track so as to restore
normal speed within three weeks of imposition of a restriction, the PPT will take action in
terms of conditions of contract and will engage such labour as is necessary at the risk and
cost of th
e contractor who attain to such portions of tracks as have been disturbed and are
under speed restriction so as to restore normal speed.


3.4

Caution watchman as necessary during day and night would be arranged for by the contractor
during execution of emergen
t works.

4.

SAFETY HAZARDS :


4.1

The works should executed in a workman like manner to the satisfaction of the
Engineer in charge. The contractor will be primarily responsible for the safety of traffic
that moves on the opened up track notwithsta
nding the presence of the PPT
Supervisory staff at site.



4.2

In the event of any accident at the workspot, and the departmental enquiry will be held
by the PPT. If it is established that the accident occurred wholly or partially due to any
set amounting to
negligence on the part of the contractor, he shall render himself
liable for all damages and also legal prosecution if loss of life is involved. No work will
be permitted after sun
-
set. All the works will be done during day light only.


5.

TOOLS & PLANTS :

Wooden chocks for deep screening will be supplied by the contractor for use in the rack for safe
passage of trains while the work is in progress.


5.2

Contractor will arrange for his own tools required for the work such as beaters, shovels,
powrahs, crow bars, cotter bending and splitting tools, screws, users of suitable diameter, box
spanners, spiking hammers, keying hammers, wooden squares, wire baske
ts for screening
morter pans, cane baskets and other tools as specified in Para 5.1 above and other tools as
required for deep screening.


5.3

The contractor should ensure that all his workmen are given equipment as necessary to work
in all adverse condition o
f weather.


5.4


Contractor will arrange required no. of tarpaulins etc. for the labourers to stay. Drinking water
and lighting arrangements required for the labourers will be made by the contractor himself.

ADDITIONAL GENERAL CONDITIONS:


1.

The tools required for the work should be arranged by the contractor at his own
cost.

2.

The contractor will be responsible for the released materials and fittings till such
time t
hey are handed over to the Engineer

Central Store by contractor’s transport . Dip lorry may be arranged by the
contractor which may be required for carrying materials only in the stretches
where contractor trucks can n
ot enter. Protection of Dip lorry will be arranged by
the contractor by providing skilled labour / Supervisor for which no payment will
be made to the contractor.

3.

No compensation towards any accident to contractor or labours/ Supervisors
what so ever wil
l be paid by the Port Trust.


4.

Labour required for protection of track with Engineering signals will be arranged
by the contractor by recruiting experienced skilled labours/ retired Railway
permanent gang man of maximum age limit 60 years.

5.

The work under Tr
affic blocks or cautioned order in which discontinuity of rail
including continuous sleeper removal as required and the same will be arranged
by the Port Trust and will be executed under Traffic block or cautioned order as
and when required, by intimation

and after obtaining order from the Traffic Deptt.

6.

Housing accommodation and drinking water arrangement for contractor’s labour
will have to be arranged by the contractor strictly as per Contract Labour Act,
1970.

7.

All materials requi
red for the work shall be taken from the Central Stores / Site Store of
the Port Trust on production of SIB or on receipt. It is
contractor’s responsibility for
transportation of materials to the site of work including all leads, lifts and crossing
of o
ne or more Railway lines as and when required on the contractor’s own risk.


8.

A joint inventory of materials required for regular track maintenance repair due to
derailment or damaged by other agencies should be taken jointly by the
Contractor and Port Tr
ust representative before taking up the work and also on
completion of the work.

9.

The contract period may be extended by the PPT for the maximum reasonable
period and the rates shall hold good during such extended period.


10.

The contractor shall employ and po
st at site a technical supervisor who will be
adequately qualified and will experienced in the execution of permanent way
works preferably a retired Railway P W I. The name, particular of technical
qualification and record of experience of the Supervisor

employed should be
advised to the Engineer
-
in
-
Charge. If the Supervisor is not fit to be in
-
charge of
the work, he should be replaced forthwith. In this matter the opinion of the
Engineer
-
in
-
Charge will be final and binding on the contractor.


11.

So far
the labour is concerned, the contractor shall engage labours at Railway
site who are well experienced in the execution of permanent way works. The
labourers so employed by the contractor, if found by the PPT authority not
suitable considering their charac
ter, cautiousness in Railway works particularly
working in adjacent to running tracks, involved in any misconduct, intoxicated
and spoiling the working atmosphere at site, they should be replaced forthwith.
In this matter, the decision of the Engineer
-
in
-
Charge will be final and binding on
the contract.

12.

No special work on track should be undertaken unless and until the contractor’s
technical Supervisor and the Engineer
-
in
-
Charge of the work are present at site.

13.

The ballast supplied by the c
ontractor, the following tests may be carried out in a
laboratory / organization or at site as decided by the Engineer
-
in
-
Charge.

14.

In all such of test as per clause

16 of Additional general con
ditions of contract
confirmed the quality of materials and the charges for such testing etc. including
carriage to laboratory, the cost of materials and transportation charges are to be
fully borne by the contractor.


15.

Fabrication and welding of steel plate

girder shall be done as per latest IRS
specifications.



SPECIAL CONDITIONS

1.

Arbitration

No arbitration will be entertained in the contract.


2.

The Materials that are issued by the Deptt. & if found in excess, should be refunded to
the Central Stores.

Balance materials, remaining unaccounted for by the contractor
will be recovered from him at two times the recovery rate as pr schedule of recovery

3.

Time is the essence of the contract. The progress of work should commens
urate
with the time schedule. The work should be completed positively within the stipulated
time mentioned below. Failing to complete the work in time, liquidated damage will be
imposed as per relevant clause of contract.

accordingly to the suitability of site for which no claim shall be entertained. The
quantity mentioned in the schedule may increase or decrease

be entertained.


7.

The contractor is required to submit his fortnightly programme of work and the time
schedule keeping in view the stipulated period of completion of the work.


8.

The contractor shall be responsible for the true

and proper setting out of work in
relation to original points, lines and levels of reference and providing with all
necessary instruments, appliances and labour in connection therewith.


9.

On completion of the work, the Contractor shall clear away and re
move from the site
the surplus materials, rubbish and temporary work to the satisfaction of the Engineer.

10.

The Contractor is not authorized to remove any or part of materials issued if any to
him by the Port Trust on any reason or any account; either a
t the time of execution or
even after completion of work without permission of Engineer
-
in
-
charge.

11.

The authority reserves the right to omit or extend execution of any or part of the items
contained in the tender schedule and may take it up departmenta
lly or through any
other agency and no claim of the contractor on this account will be entertained.

In the event of slow progress of work, the authority reserves the right to distribute the
work among the contractors for speedy execution for which

no compensation or any
financial claim shall be entertained.


12.
