FINDINGS

The Westford Conservation Commission has reviewed the above
-
referenc
ed Notice of Intent and plans
and has held a public hearing on the project. Based on the information available to the Commission at
this time, the Commission has determined that the area on which the proposed work is to be done is
significant to the wetla
nd values in accordance with the purpose of the Westford Non
-
Zoning Wetlands

Therefore, the Commission hereby finds that the following conditions are necessary to protect those
Wetland Values checked above. The Commission orders that all work shall be performed in accordance
with said conditions
and with the Notice of Intent referenced above. To the extent that the following
conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of
Intent, the conditions shall control.

GENERAL CONDITIONS:

1.

Failure t
o comply with all conditions stated herein, and with all related statutes and other
regulatory measures, shall be deemed cause to revoke or modify this Order.

2.

This Order does not grant any property rights or any exclusive privileges; it does not authorize
any injury to private property or invasion of private rights.

3.

This Order does not relieve the permittee or any other person of the necessity of complying with
all other applicable federal, state or local statutes, ordinances, bylaws or regulations.

4.

The wor
k authorized hereunder shall be completed within three years from the date of this Order
unless the time for completion has been extended to a specified date more than three years, but
less than five years, from the date of issuance and both that date and
the special circumstances
warranting the extended time period are set forth in this Order.

5.

This Order may be extended by the issuing authority for one or more periods of up to three years
each upon application to the issuing authority at least 30 days prio
r to the expiration date of the
Order.

6.

Any fill used in connection with this project shall be clean fill, containing no trash, refuse,
rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper,
cardboard, pipe, tires, ashes
, refrigerators, motor vehicles or parts of any of the foregoing.

7.

No work shall be undertaken until this Order has been recorded in the Registry of Deeds or the
Land Court for the district in which the land is located, within the chain of title of the affe
cted
property. In the case of recorded land, the Order should also be noted in the Registry’s Grantor
Index under the name of the owner of the land upon which the proposed work is to be done. The
recording information shall be submitted to the Commission

on the form at the end of this Order
prior to commencement of the work.

8.

A sign shall be displayed at the site not less than two square feet or more than three square feet in
size bearing the words: Westford Conservation Commission File #
016
.

9.

Upon compl
etion of the work described herein, the applicant shall forthwith request in writing
that a Certificate of Compliance be issued stating that the work has been satisfactorily completed.

The work shall conform to the following plans and conditions:

SPECIAL CONDITIONS:

11.

Accepted engineering and construction standards and procedures shall be
followed in the completion
of the project.

12.

As
-
built Plans for the project, certified by a registered architect, engineer or land surveyor acceptable
to the Commission, shall be submitted specifying how the completed work differs from that shown in
the orig
inal plans reviewed by the Commission.

13.

All on
-
site septic disposal systems shall be in full compliance with the Massachusetts Environmental
Code, Title 5, and any additional requirements established by the Board of Health..

14.

This Order of Conditions shall a
pply to any successor in interest of successor in control.

15.

Members and agents of the Conservation Commission shall have the right to enter and inspect the
premises to evaluate compliance with the Conditions, and the Commission may require the submittal
of
the Conditions, and the Commission may require the submittal of any data deemed necessary by
the Commission for the evaluation.

16.

All facilities and equipment shall be continually operated and maintained so as to comply with the
Conditions and the Act.

17.

Any c
hange or changes, made or intended to be made in the Plans, shall require the applicant to file a
new Notice of Intent, or to inquire of the Commission in writing whether the change or changes are
substantial enough to require a new filing.

18.

The Commission
is authorized to file the Order of Conditions in the Registry of Deeds should the
applicant fail to do so, or should the applicant fail to deliver to the Commission a certified copy of
such filing showing book and page, within one month.

19.

This Order of Cond
itions shall be reviewed with and a copy provided to all contractors and
engineers working on the site involved with site preparation, earthwork and landscaping. A
copy of said Order of Conditions and referenced plans and documents shall be onsite during
all
construction activities. Any other plans not consistent with the Order shall not be onsite.

20.


Notice shall be given to the Commission or its agent no more than one week and no less than
two (2) days prior to the commencement of any construction activiti
es, including onsite
trucking of fill and major removal of site vegetation.

21.

Prior to the performance of any other site work, including onsite trucking

of fill and major
removal of site vegetation, an erosion/sedimentation/work limit control feature consisting of
staked haybales backed up by silt fence shall be properly installed between the work area and
the wetlands in the location shown as "Proposed S
taked Haybales & Siltation Fencing" on the
Plan of Record. This erosion/sedimentation/work limit control feature shall be properly
installed and inspected and approved by the Commission or its agent prior to the
commencement of any other work on the site.

22.

There shall be no operation of equipment, removal or cutting of vegetation or disturbance of
any kind in the area between the erosion/sedimentation/work limit control feature described in
condition number 21. and the wetlands and this area shall be left in

its existing state.

23.

Within one week of the installation of the house foundation, a certification and plan prepared
and stamped by a Massachusetts licensed surveyor shall be submitted to the Commission
showing the location of the foundation as actually ins
talled in relation to the location shown on
the Plan of Record. If the foundation is closer to the wetlands than shown on the Plan of
Record, then all work shall immediately be stopped on the project and the site stabilized until
such time as the Commissio
n can consider appropriate action in relation to the changed house
location.

24.


All erosion and sedimentation control features shall be maintained in proper working
condition during and after construction. Accumulated siltation at the sedimentation barriers

shall be removed as needed to a proper upland disposal location.

The erosion sedimentation barrier should be removed promptly following satisfactory
permanent stabilization of the site.

25.

All disturbed areas shall be permanently stabilized by loaming and se
eding as soon as possible
following completion of site regrading. Those areas not permanently stabilized by December
1 shall be appropriately, temporarily stabilized for the winter months using erosion control
blankets or jute mesh and hay mulch.

26.


All con
struction equipment, including, but not limited to machinery, heavy equipment and
vehicles shall be parked and stored more than 100 feet from any wetlands when not in use. All
fuels, lubricants and hydraulic fluids shall be stored more than 100 feet from
any wetlands.
All refueling and maintenance involving transfer of oils and hydraulic fluids shall be
performed more than 100 feet from any wetlands.

27.


All excavate, fill, loam and any other earthen materials associated with the project shall be
stored and
stockpiled more than 100 feet from any wetlands. No excavate, fill, loam or other
material shall be stockpiled against the erosion/sedimentation/work limit control feature
described in condition number 21.

28.

No fill, excavate, construction debris or equipment shall be a
llowed to enter the wetlands; any
such material entering the wetlands shall be removed immediately. No trees or shrubs shall be
felled into or disposed of in the wetlands.

29.


No site work shall be performed within 100 feet of any wetlands between December 1

and
April 1, except with the permission of the Conservation Commission or its agent.

30.

Upon completion of the project the proponent shall request a Certificate of Compliance.
Should the completed work differ from the original plan and conditions, the repor
t/request
shall specify and explain the deviation and they shall be shown on the "as
-
built" plan.
