TERMS AND CONDITIONS


1. The work shall generally be governed by KIOCL Limited General Conditions of Contract, which
is available for reference in th
e office of the DGM (Contracts), KIOCL Limited BF Unit on all
working days.


2.

The quantities given in the schedule of items are approximate and may vary. Some of the items
may not be executed; no claims by the Contractor on account of variations, omissions
&
modifications will be entertained.


3.

No escalation is admissible on any account whatsoever.

4.

Mode of measurement for the work shall be as per
IS
-
1200 latest edition. Unless otherwise
specified for items not covered in
IS
-
1200, CPWD standard shall be
adopted.


5.

Quoted rates against schedule items shall include labor charges, consumable materials and
hire charges, applicable Taxes, Royalties transport, maintenance incidents enabling work etc.,
except service tax based on the conditions mentioned herein.
Unless otherwise specified in the
tender schedule the rates for all items will be deemed to include all leads, lifts & descents in
the work.


6.

The work executed shall be maintained in good condition for a period of

including repair required if any at Contractor’s cost. If the Contractor
fails to fulfill his obligation during the maintenance period, the same shall be got done by the
owner at contractor's risk and cost.


7.

Security Deposit

a)

Within 15 days of the aw
ard of the Contract, Contractor shall deposit with KIOCL
Limited BFU an initial Security Deposit of 3% (three percent) of the Contract Value
and the same shall be in cash or in any of the following forms.


i)

Demand drafts drawn in favour

of KIOCL BFU from any Nationalised / Scheduled
Bank.


ii)

Bank Guarantee in prescribed Proforma, executed by a Nationalised Bank /
Scheduled Bank. If the bank guarantee is from a non
-
Indian Bank, the same shall
be got stamped at Bangalore, Karnataka State, I
ndia, by the Foreign Banker’s
Associates / Subsidiaries or agents in India, in accordance with the laws
applicable in State of Karnataka, India .



b)

As and by way of additional security, from every progressive bill of Contractor,
Security Deposit at the
rate of 7% of the Gross Value of such bill as determined
before payment shall be retained by KIOCL Limited BFU or Contractor can submit
additional Security Deposit by Bank guarantee.



c)

The Security Deposit shall be refunded after successful completion o
f work or
maintenance period as applicable.


d)

The EMD shall be returned after submission and acceptance of the initial Security
Deposit.


e)

In case of failure to commence the work, EMD submitted is forfeited.

8.

Any damage to the Company's property caused by the Contractor during the
execution/maintenance of work, shall be charged to the Contractor and the amount of
damage shall be left to the sole discretion of the Engineer.


9.

Statutory deduction towards all app
licable taxes shall be made as per rules.


10.

Royalties if any for materials applicable shall have to be paid by the Contractor and included
in the cost of tender.


11.

All Safety appliances like Helmet, shoes etc. have to be provided by the Contractor to all h
is
workers and Supervisors at no extra cost of KIOCL Limited, BF Unit. None of the workmen
without safety appliances shall be allowed to work.


12.

Safety requirements
:
-


a)

Contractor and his work force shall follow strictly, all the safety rules given in General
Safety rules, especially for contractor and contractor’s labors, a copy of which is kept at our
office for reference and instructions given by Engineer
-
in
-
charge/ Sa
fety Dept. from time to
time in the course of job.


b)

None of contractor’s men shall move out side the specified limit of working place.


c)

All the persons deployed on the job shall use safety helmets and goggles, shoes, safety belts
and hand gloves as appli
cable. Any person found without the safety gadgets shall be
removed from the work site.


d)

Contractor shall use only standard and tested lifting tools/ tackles on the job and shall
produce relevant test certificate on demand by owner’s Engineer
-
in
-
charge/ S
afety Dept.


e)

Supervisor and employees deployed on job has to undergo training by KIOCL Limited BF
Unit Safety unit along with contractor, if he has not undergone such training previously.
This training should be undergone before issue of gate pass.


13.
The contractor shall abide by the provisions in the Water consent; Air consent and
Hazardous management consent applicable to our company.


14. The Contractor shall abide with all the provisions contained in Factories Act 1948 and Rules/
Regulation/
By laws/ orders made there under.


15. The Contractor should obtain Insurance Policy to cover the risk of the labours under
Workmen Compensation Act and should be produced before starting the work.

This is
mandatory for those contractors who do not have ES
I number of their own.


16.
Contractor should furnish the PF & ESI code numbers obtained from respective authorities



and also produce the same to the Personnel Department before commencement of the work.


However, in case a contractor who does not have PF & ESI code number, should apply for



PF & ESI code numbers from the respective authorities based on the LOI/Work Order issued


to them and produce the same to Personnel Departme
nt.

. The Contractor has to make his own arrangement for accommodation, transportation, canteen
facility on a bulk basis to the Contractor at Non Subsidized Rates will be provided if
requested by the Contractor.

. Time of completion a
nd Liquidated Damages.


The entire work under this Contract shall be completed within

If the Contractor fails to complete the work
within the stipulated completion time, the contractor shall
pay to owner liquidated damages
for such default, for every day which shall elapse between the date prescribed thereof and
the actual date completion of the scope of work, the amounts determined on the basis of the
percentage of the apportioned value of su
ch components as specified herein.

The contractor shall take photo entry pass from CISF f
or his laborers, if the work order
period is more than seven days, without fail. These photo passes should be taken by the
contractor well in advance before taking up the job. If the work order period is less than
seven days, then CISF will issue te
mporary pass. No laborers will be allowed to enter plant
premises without these entry passes.

. The works mentioned at the schedule of work are temporary in nature.

Bids shall be valid for a period of

from the due date of submission of the bid.

TAXES & DUTIES:

This clause shall be applicable not withstanding any other clause related to
taxes and duties mentioned elsewhere in this tender document.


a.

The rate quoted shall be inclusive of all taxes a
pplicable for this work except Service tax.


b.

The applicable service tax will be reimbursed on production of proof of remittance of
Service Tax as per Rule 6(1) of Service Tax Rules for those contractors who do not have
Service Tax Registration Number.


c.

For

contractors who are having Service Tax Registration No. , the Service Tax will be paid
extra based on claim of the contractor. However, the contractor shall produce a copy of
half yearly return of Service tax filed at the office of the Superintendent of
Central Excise.
The final bill / SD will be released after production of the copy of half yearly return.

The contractor shall disburse the wages to the labour on or before 7

of the following
month and furnish copy of wage register, muster roll a

award but also as may be notified from Pe

. Every one may take a note that a “Fraud Prevention Policy” is being followed at KIOCL
Limited, which provides a system for prevention/ detection/ reporting of any fraud. It also
forbids everyone

from involvement in any fraudulent activity and that where any
fraudulent activity suspected by anyone, the matter must be reported to the ‘Nodal Officer’
(Chief Vigilance Officer) as soon as he/she comes to know of any fraud or suspected fraud.



26.

SPECIAL CONDITIONS


1

Contractor shall visit the site of work to acquaint himself

with the type of work involved, site
conditions prevailing and other environmental factors prevailing in Plant area which are
contingent upon scope of work envisaged under this contract.

2

Except for item No. 3, all structural steel sections required for this work including bolts, nuts,
washers and any other
hardware
, consumables like Oxygen, LPG, welding electrodes shall be
provided by KIOCL Ltd
-
BFU free of cost. Supply of coal tar black pa
int and epoxy thinner will
also be made by BFU fee
of cost

for both items 2 & 3.

For jobs under item No.3, the agency may get the floor gratings fabricated in outside workshops
using ISA 50X50X6 and MS flat of 40X6 size (Material supply in agency's
scope), as per the
required dimensions. However the Contractor has to keep a record of materials entering inside
the main gate after inspection by the Engineer in charge. Transportation of the fabricated floor
gratings from outside workshop in such case is

the responsibility of the Contractor only.

For shifting of owner issued items from Stores (structural steel and paints), the Contractor has
to make necessary arrangement to collect these items and shift to work spot. Owner's
equipment such as loader fo
r shifting of these materials shall be provided on free of cost basis,
subject to the availability.

5

Required welding machine (One No.)will

be given to the agency free of cost by BFU. Agency has
to shift the machine wherever required. Power for welding will be made available to the agency
for the above job by BFU free of cost.

Tools & tackles like chain pulley block, welding cables, gas
cutting set with regulators, grinding
machine, welding head shield with glass, wire brush, paint brush, junction box with power
extension cables shall be arranged by the Contractor at his cost.

7

Site of work is within the prohibited area. All entries/ ex
its for men and material shall be
through the main gate, all of which are manned by Central Industrial Security Force (CISF) staff.
Entry /gate passess duly countersigned by the department HOD are therefore required to be
furnished at these gates.

8

All
material like tools & tackles brought to the site shall be safeguarded and protected against
theft and weather conditions. Contractor shall maintain proper records of entry.

9

All equipments, tools and tackles including scaffolding, ladders and ropes
etc., required for the
job shall be supplied and maintained in serviceable condition by the Contractor and shall be
strictly fulfill the structural requirements of tools and equipments. The relevant test certificates
for tools like chain pulley blocks, sli
ngs, D
-
shackles, etc which are brought inside the site for the
work to be produced by the Contractor on demand by the Engineer in Charge.

General shift working hours inside the plant shall be from 8:30 AM to 5:00 PM. Height permit
will be given for working in certain critical areas which involve working at height more than
3m. Contractor has to ensure that the height permit is ensured when w
orking at height and
necessary safety precautions are taken by providing safety helmets, shoes, safety belts, hand
glouses, goggles, etc throughout the job. The safety appliances given to the workers shall have
ISI brand wherever applicable and should not
be of substandard quality.

After completion of the job in each area, the Contractor has to ensure that all the scraps
generated are cleared including the empty paint drums, welding rod butts, cut pieces of new
steel material and complete
housekeeping

is done to the satisfaction of Engineer in Charge.

Above shown quantity of work is maximum during estimation. Payment will be made for actual
completed job based on field measurement and submission of invoice certified by the Engineer
in Charge (unit weight shall be taken from the standard steel table for
erected/strengthened
members as per the joint measurement for item No.2, weighment ticket obtained from the
weigh bridge for item No. 1 and for item No. 3, the basis of measurement is square
meters

of
gratings supplied and erected).

Maintenance period
applicable for the above job may be taken as 12 months from the date of
completion against the workmanship.



DETAILED SCOPE OF WORK


A.

BLAST FURNACE AREA: App. 9 MT

1.

Above bustle main pipe, damaged walkway chequered plates/gratings, supporting channels

and hand rails to be replaced.

2.

In Bosch level of the Furnace, 2 Nos. of small staircases connecting to two nos. of circular

walkways(Cast house side), chequered plates
, supporting channels, handrails to be


repaired/replaced.

3.

In 18m level, corroded/damaged redundant structures to be removed by gas cutting.

4.

In 21m level, towards Cast house side damaged chequered plates and supporting members to


be replaced.

5.

Below 24m

level floor, hanging pieces/section of old damaged gratings to be removed by gas

cutting.

6.

In 24m level, damaged chequered plates & handrails towards Cast house side, inside Power

pack room to be replaced along with supporting members. Opened up chequere
d plates to be

positioned and completely welded. Also redundant damaged structures welded to different

members to be removed by gas cutting.

7.

Connecting & supporting members of the staircase leading from 24m level to 28m level to be

replaced. Staircase
to be strengthened.

8.

Maintenance platform near to the top cone man holes (28m level) at both sides to be

replaced/strengthened.

9.

Walkway supporting channels & chequered plates from lift 2
nd

floor to 28m level of the

Furnace to be replaced.

10.

Walkway leading to Stove top to be provided with chequered plates, handrails and

strengthened wherever required.

11.

Lift well connecting members from stairwell (near lift 2
nd

floor) to be replaced wherever

damaged.

12.

BDV maintenance platform to be strengthene
d by replacing the floor members.

13.

GAS CLEANING PLANT(GCP)/EFFLUENT TREATMENT
PLANT(ETP) AREA: App. 5 MT


1.

After Septum Valve/Goggle Valve, entire bracings of gas line supporting trestles above power
pack to be replaced along with ladder supporting brackets.


2.

Launder supporting first column after GCP to be replaced alongwith the b
racings.


3.

2 Nos. of launder supporting columns near Thickener 2 (where MW/FW/GCP water supply
pipelines rise and next one towards Thickener) to be replaced/strengthened along with
damaged bracings.


4.

Launder walkway chequered plates, supporting channels, handrails to be replaced near the
first column and other places wherever required. Opened up welding to be re

welded after re
-
positioning the chequered plates. Launder flanges to be repaired at two pla
ces.

In CGP different floors, openings near the columns to be covered suitably. Handrails (top
floor) to be provided wherever damaged/missing.

Staircase between GCP and DC to be strengthened at both ends.

PCM AREA: App. 4 MT


1.

Interconnecting beams on return side of both the strands require replacement.(1 No. each in
both strands).

Inside both the return chutes, one no. each interconnecting beams to be replaced as they are
damaged.

Return side middle walkway to be provided with toe guards and middle member for the
existing handrails.
