The Board recognizes that cellular phones have become an important tool through which people
communicate. Therefore, students are permitted to possess cellular phones and wireless
communication devices on school property as long as such devices are not on, used, displayed or
visible during the school day or as otherwise directed by school administration. Wireless
communication devices include, but are not limited to, cellular phones, paging devices, two-way
radios, CD/MP3 players, electronic games and any new electronic wireless communication
device that may become available to the general public in the future.

Students are allowed to be in possession of wireless communication devices, but the use of the
aforementioned is prohibited during the school day.

1. Administrators may authorize individual students to use wireless communication devices if
deemed necessary. Teachers and administrators may authorize individual students to use the
devices for instructional purposes provided that they supervise the students during such use.

2. For school bus riders to and from school, the use of wireless communication devices is
strictly prohibited at any time the student is on the school bus.

3. For car riders and student drivers the use of wireless communication devices is strictly
prohibited from the time of drop off or arrival at school until the time the student is dismissed
from school.

4. For any extra-curricular or after-school events requiring school transportation,
possession and
use of wireless communication devices will be allowed on the bus with permission of
supervising school staff.

5. In addition, elementary and middle school students who participate in instructional type after-
school programs such as 4-H, tutoring, etc., are prohibited from using wireless communication
devices for the duration of such programming.

6. Parents who need to reach their child during the school day due to an emergency or other
valid reason should call the school’s main office rather than attempting to contact their child on
his/her cellular phone.

School employees may immediately confiscate any wireless communication device that
is visibly turned on, used, displayed or visible in violation of this policy. In the absence of
compelling and unusual circumstances, confiscated wireless communication devices will be
returned only to the student's parent or guardian. It is the student’s responsibility to ensure that
his/her cell phone or other wireless communication device is turned off completely and kept out
of sight.

In the event of reasonable suspicion of unlawful content, including photos and texts, the cell
phone or wireless device may be relinquished to law enforcement officials.

Violations of this policy will result in consequences as provided below:

Offense: Wireless communication device will be confiscated and returned to parent/guardian
following a conference with the school administrator. The student will be subject to Out-of-


School Suspension (OSS) until the parent conference occurs. The school administrator will be
required to review the policy regarding electronic devices at school with the parent during the
conference and the parent will be required to affix their signature to documentation verifying that
the policy has been reviewed. A copy of the policy with the completed parent verification form
shall be kept on file and will be referred to in the event of further violation of the policy.

Offense: Wireless communication device will be confiscated and the student will
immediately be subject to Out-of-School Suspension (OSS) for one day. The wireless
communication device will be returned to the parent/guardian following a conference with the
school administrator.

or Subsequent Offenses: Wireless communication device will be confiscated and the student
will immediately be subject to Out-of-School Suspension (OSS) for three days. The wireless
communication device will be returned to parent/guardian following a conference with the
school administrator.
Aggravating factors shall subject a student to more stringent disciplinary consequences, in
accordance with Wayne County Public Schools Board of Education Policy No. 4300 –
Discipline. Examples of such aggravating factors include, but are not limited to, using wireless
communication devices: (1) to reproduce images of tests, to access unauthorized school
information or to assist students in any aspect of their instructional program in a manner that
violates any school board policy, administrative regulation or school rule; (2) to take or show
illicit photographs; and (3) to take photos or videos of fights, disruptions, bullying, etc. or
uploading these images to any social networking site, YouTube or any other public internet site.

IABILITY


Students are personally and solely responsible for the security of their wireless communication
devices. The school system is not responsible for the theft, loss or damage of a cellular phone or
any other personal wireless communication device.

I have read (or it has been read to me), understand, and will abide by the Wayne County Public
Schools Use of Wireless Communication Devices Policy (4318). I understand that should I
commit another violation of this policy regarding any wireless communication device including a
cell phone, that I may be subject to immediate Out-of-School Suspension for one day and that
the device can be confiscated and kept by the school administration until a parent/guardian
conference is held. I further understand that a third and subsequent violations of Policy 4318
may result in an immediate Out-of-School Suspension for three days and the device will be kept
by the school administration until a parent/guardian conference is held.

PARENT OR GUARDIAN (If the student is under the age of 18, a parent or guardian must also
read and sign this agreement.)

As the parent or guardian of this student, I have read the Wayne County Public Schools Use of
Wireless Communication Devices Policy (4318) and I understand that if my child violates this
policy regarding any wireless communication device including a cell phone, that the device can
be confiscated following each violation and kept by the school administration until a
parent/guardian conference is held. I also understand that my child may be subject to an
immediate one day Out-of-School Suspension for the second violation of Policy 4318, and an
immediate three day Out-of-School Suspension for the third and subsequent violations.

I further understand that the school and school system are not responsible for the theft, loss or
damage of a cellular phone or other wireless communication device that belongs to a student and
which may have been confiscated in accordance with Policy 4318.
