Building Services and informed the Committee that he would withdraw from the meeting at
the appropriate time.

Planning Applications


The Chairman referred to the decision

taken by the Committee at their meeting held on 23
January 2002 with regard to conditions to be imposed on planning permission 01/01968/OUT
relating to light industrial use etc. including change of use of agricultural to B1 on land
adjacent Alfresco, Brad
field Road, Wix. He informed the Committee that such conditions
were listed in Members Bulletin Issue 302.

The Development Control Manager updated the Committee with
regard to the above and
submitted details of a letter received from the Highways Agency.

BATHSIDE BAY


TIDAL WORKS AND APPROACH CHANNEL DEEPENING


Members recalled th
at at their last meeting (Minute 94) it had been resolved that the Acting
Head of Planning and Building Services, in consultation with the Chairman, or failing him the
Vice
-
Chairman, of the Committee should send an interim response to the Department of
Tra
nsport, Local Government and the Regions concerning the Environmental Statement that
had been submitted in respect of the proposed works at Bathside Bay, Harwich.


It was moved by Councillor Oxley, seconded by Councillor De

RESOLVED


(a) That the response that has been submitted to the Department of Transport,
Local Government and the Regions in respect of the Environmental Assessment concerning
the proposed Tidal Works and Approach Channel Deepening at Bathside Bay, Harwich, as
set o
ut at Appendix A to the Report of the Acting Head of Planning and Building Services,
be noted.


(b) That a further report be submitted to the Committee in due course.


109.

“PLANNING: DELIVERING A FUNDAMENTAL CHANGE”


Members had before them a report concernin
g the Green Paper entitled “Planning: Delivering
a Fundamental Change” which had recently been issued for consultation.


Members noted that copies of the Green Paper and the three “daughter” documents had been
placed in the Members’ Rooms at Weeley and at
the Town Hall, Clacton and could also be
viewed on the Department of Transport, Local Government and the Regions’ website.


Members were invited to submit any comments that they may have on the documents to the
Planning Portfolio Holder by 28 February 2002
.

APPLICATION PREVIOUSLY DEFERRED BY THE COMMITTEE


The Committee considered application 01/01976/FUL for planning

permission as set out in
Schedule 1 to the Report of the Acting Head of Planning and Building Services, together with
a recommendation thereon and the observations of Frinton and Walton Town Council.


In respect of the application the Committee were infor
med that observations on the proposed
development had been received and were summarised in Schedule 1 to the Report of the
Acting Head of Planning and Building Services and that copies of all written observations
had been made available for inspection in a
ccordance with the decision of the former
Development and Planning Committee as contained in Minute 16 (30.6.75).

PLANNING APPLICATIONS



The Committee considered applications for planning permission
as set out in Schedule 3 to
the Report of the Acting Head of Planning and Building Services, together with
recommendations thereon, the comments, where appropriate, of the technical consultees and
the observations in those instances where received of the a
ppropriate parish council.


In respect of applications 01/01195/FUL and 01/01811/FUL the Committee were informed
that observations on the proposed developments had been received and were summarised in
Schedule 3 to the Report of the Acting Head of Planning

and Building Services and that
copies of all written observations had been made available for inspection in accordance with
the decision of the former Development and Planning Committee as contained in Minute 16
(30.6.75).


It was reported that in respect

of application 01/01195/FUL a further letter of observation had
been received from a member of Wix Parish Council and details thereof were submitted to
the Committee.


During consideration of application 01/01811/FUL, it was moved by Councillor Harper and

seconded by Councillor Oxley that consideration of the application be deferred to enable an
organised site visit to take place, which motion on being put to the vote was declared
LOST
.


Also during consideration of application 01/01811/FUL, it was moved b

and seconded by Councillor De

Vaux Balbirnie that consideration of the application be
deferred to allow the officers time to investigate other issues relating to the use of the site,

Following consideration of application 01/01811/FUL, the meeting was adjourned and the
Chairman of the Committee withdrew from the meeting as he was feeling unwell.

Chairman, Councillors Elmer and De Roy were proposed and

conded to occupy the Chair for the remainder of the meeting.


Councillor De Roy was elected as Chairman for the remainder of the meeting.


Councillor Ling declared a pecuniary interest in respect of application 01/02090/FUL and
withdrew from the meeting du
ring the consideration thereof and the voting thereon.

(a) That those applications listed in Schedule 1 to these Minutes, as were
considered under this item of the Minutes, be approved subject to the conditions as set out
therein.

reason as set out therein.


112.

APPLICATIONS AFFECTING LISTED BUILDINGS OR BUILDINGS IN

CONSERVATION AREAS


The Committee considered one application for Conservation Area Consent

and two
applications for planning permission as set out in Schedule 4 to the Report of the Acting Head
of Planning and Building Services, together with recommendations thereon, the comments of
the technical consultees and the observations of the appropria
te parish council.

In respect of application 01/01175/FUL the Committee were informed that observations on
the proposed development had been received and were summarised in the

Addendum Report
of the Acting Head of Planning and Building Services and that copies of all written
observations had been made available for inspection in accordance with the decision of the
former Development and Planning Committee as contained in Minute

16 (30.6.75).


Members were informed that in respect of application 01/01175/FUL a further three letters of
observation and further comments from Economic Development Services had been received
and details thereof were submitted to the Committee. It was
also reported that in respect of
the application further information had been received from the applicant and a full report on
the garden structures.

(a) That those applications listed in Schedule 1 to these Minutes, as were
considered under
this item of the Minutes, be approved subject to the conditions as set out
therein.
